Dispensaries

The Colorado Medical Marijuana Registry authorized the licensing and operation of Medical Marijuana Centers (MMC’s) and Medical Marijuana-Infused Products Manufacturers, from which registered patients or designated primary caregivers, acting on behalf of the patient, may purchase medical marijuana and marijuana-infused products. When these entities have an Optional Premises Cultivation license, they are also allowed to cultivate marijuana for medical purposes only.

The Marijuana Enforcement Division (MED) is the agency responsible for the formulation and implementation of rules and regulations for both Medical and Retail Marijuana industries which will be governed with district and separate statutes.

In the process of registration, the qualifying patient shall indicate on his application any of the following sources of his medical marijuana:

  • Cultivation of his own marijuana
  • Obtaining marijuana from both personal cultivation and from either the primary caregiver or licensed medical marijuana centers
  • Obtaining marijuana from either the primary caregiver or a licensed medical marijuana center

If the qualifying patient opts to use a licensed medical marijuana center, the patient shall register the location of the medical marijuana center he intends to use on his application.

Visiting a Dispensary

Before medical marijuana may be dispensed to a registered qualifying patient or his designated caregiver directly, the center agent must determine that the individual making the purchase is a current cardholder by verifying each of the following:

  • That the registry identification card presented is valid;
  • That the person presenting the card is the person identified on the registry identification card presented at the time of the purchase and presented to the agent; and
  • That the marijuana medical center is the designated center of the qualifying patient as registered in his registration card.

The qualifying patient and the designated caregiver may possess no more than two (2) ounces of a usable form of marijuana between one another at any given time.

Starting a Medical Marijuana Center

Applications for a State License shall be submitted to the State Licensing Authority on required forms prepared and furnished by the agency.

The following information is required on the license application:

  • The name and address of the applicant
  • The names and addresses of the officers, directors, or managers
  • All other information deemed necessary by the licensing authority

Each application shall be subject to verification as maybe prescribed by the licensing authority.

The law provides that all owners, officers, managers, and employees of a medical marijuana center, optional premises, cultivation operation, and medical marijuana-infused products manufacturers shall be residents of the state of Colorado.

A license shall not be issued until the license application due to the state has been received by the Department of Revenue. All licenses issued shall be valid for a period of up to two years from the date of issuance unless revoked or suspended by the licensing authority.
